These terms and conditions (“Terms of Service”) constitute a legally binding agreement between you, the user of this website, and Precious Prints Ltd (“we”, “us”, or “our”).
By accessing, browsing or otherwise using this website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree, you must refrain from using the website immediately.
We reserve the right to amend these Terms of Service from time to time. Continued use of the website following any such changes constitutes acceptance of those amendments.
You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms of Service.

Unless otherwise expressly indicated, all content, materials, graphics, trade marks, trade names, logos, product names, software, and underlying source code published on this website remain the exclusive property of Precious Prints Ltd or its licensors.
You are granted a limited, revocable, non-exclusive licence to access and use the website for personal, non-commercial purposes only. All other use, reproduction, distribution or modification is prohibited without our prior written consent.

Where you create an account on our website, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
You must notify us immediately of any unauthorised use of your account. We disclaim all liability for any loss or damage arising from your failure to comply with this obligation.
We reserve the right, at our sole discretion, to suspend, restrict or terminate accounts at any time without liability.

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion.
Prices are denominated in pounds sterling (GBP) and include VAT unless otherwise stated. Delivery charges are applied as displayed at checkout.
Full payment is required at the point of order. Title in the goods shall not pass to you until payment in cleared funds has been received in full by us.
We may revise prices at any time. Such changes shall not affect orders already confirmed by us.

Any delivery dates or times provided are estimates only and do not constitute contractual obligations. Time shall not be of the essence in relation to delivery.
Risk of loss or damage to goods passes to you upon delivery. Title passes only upon receipt of cleared payment in full.
We shall not be liable for any delay or failure in delivery caused by circumstances beyond our reasonable control.

Subject to clause 6.2, you may cancel your order within 14 calendar days of receipt of goods in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
The right of cancellation shall not apply in respect of goods which are personalised, customised, or otherwise made to your specification, unless such goods are faulty or misdescribed.
Goods which are faulty or not as described are protected under the Consumer Rights Act 2015, entitling you to a repair, replacement, or refund in accordance with your statutory rights.
To exercise your right of cancellation, you must provide us with a clear statement of your decision to cancel within the 14-day period. You shall bear the cost of returning goods.

By uploading, submitting or otherwise transmitting any artwork, images, text or other materials (“User Content”) to our website, you grant us a worldwide, irrevocable, royalty-free, transferable licence to use, reproduce, adapt, distribute, publish and display such User Content for the purposes of fulfilling your order and promoting our business.
You warrant and represent that you have full rights and authority to provide such User Content and that its use by us will not infringe any third party rights, including intellectual property rights, rights of privacy, or data protection rights.
We reserve the right to refuse to process, publish, or fulfil any order that we reasonably believe infringes these Terms of Service or applicable law.

Nothing in these Terms of Service shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited by law.
To the fullest extent permitted by law, we disclaim all warranties, representations and conditions, express or implied, in relation to this website and the goods or services supplied.
We shall not be liable for any indirect, consequential or economic losses, including but not limited to loss of profits, contracts, goodwill, data, or business opportunities.
Our total liability to you in respect of any claim or series of claims shall not exceed the total price paid for the goods giving rise to such claim.

We reserve the right to suspend or permanently terminate your access to the website where you are in breach of these Terms of Service or where we reasonably suspect misuse.
Termination shall not affect any accrued rights, remedies, obligations or liabilities existing at the date of termination.

These Terms of Service and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by and construed in accordance with the law of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or in connection with these Terms of Service.
